Terms of Service & SLA

1. Introduction

These Terms of Service ("Terms") govern your use of the HypHosting platform, including our website, control panel, and all related services. HypHosting is operated from the Netherlands. By creating an account or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

You may use your server for any lawful purpose related to gaming and community hosting. However, the following activities are strictly prohibited:

Violations may result in immediate suspension or termination of your account without refund.

5. Payment & Billing

All prices are listed in euros (EUR) and include applicable taxes unless stated otherwise.

6. Server Resources

Each hosting plan includes dedicated resources such as RAM and storage as described on the order page. CPU and network bandwidth are subject to fair use.

Because our infrastructure is shared among multiple customers, we reserve the right to limit or throttle a server that is consuming excessive resources to the point where it negatively impacts other customers. We will always try to notify you and work toward a solution before taking action.

8. Service Level Agreement (SLA)

8.1 Uptime Guarantee

HypHosting guarantees 99.9% monthly uptime for all paid hosting services. This means no more than approximately 43 minutes of unplanned downtime per month.

Uptime is measured as: (total minutes in month − downtime minutes) / total minutes in month × 100.

8.2 What Counts as Downtime

Note: Only infrastructure-level issues count as downtime. If your server crashes due to plugins, mods, or misconfiguration on your end, that is not considered downtime under this SLA.

8.3 Exclusions

The following situations do not count against the uptime guarantee:

If we fail to meet the uptime guarantee, you are entitled to service credits based on the actual monthly uptime:

Monthly Uptime Service Credit
99.0% – 99.9% 10% of monthly fee
95.0% – 99.0% 25% of monthly fee
90.0% – 95.0% 50% of monthly fee
Below 90.0% 100% of monthly fee

Credits are applied to the next billing cycle. The maximum credit is 100% of one month's fee. Credits are not refundable as cash.

We monitor all hosting nodes 24/7 using automated health checks. Current uptime statistics are available on our status page. Infrastructure monitoring runs every 5 minutes.

9. Suspension & Termination

We may suspend or terminate your account and services under the following circumstances:

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — your server will remain accessible until then.

After your subscription ends (whether by cancellation or termination), your server data will be retained for a 7-day grace period. After this period, all data will be permanently deleted.

10. Intellectual Property

The HypHosting name, logo, control panel software, website design, and all related branding are the intellectual property of HypHosting. You may not copy, modify, or redistribute any part of our platform without prior written permission.

You retain full ownership of and responsibility for all content you upload, create, or host on your server, including world files, plugins, mods, and configurations.

11. Limitation of Liability

Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Dutch or EU law, including liability for fraud or wilful misconduct.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The "Last updated" date at the top of this page will always reflect the most recent revision.

For material changes that significantly affect your rights or obligations, we will notify you by email at least 14 days before the changes take effect. Your continued use of our services after the updated Terms take effect constitutes acceptance of those changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms or your use of our services shall be submitted to the competent courts in the Netherlands.
